Federal Court judges Datuk Mary Lim Thiam Suan and Datuk Abdul Karim Abdul Jalil allowed Sanjeevan’s motion while Datuk Rhodzariah Bujang dissented.

“The court allows leave to only one of the four questions to be determined by the court,” Lim said.

The bench allowed the question which it amended to as follows: Where an order issuing the writ of habeas corpus is made in relation to the remand of a person, is it a necessary implication of such order that the detention was not affected in accordance with the law under Article 5(2), Federal Constitution (FC), and was thus unlawful for contravening Article 5(1), FC and amounting to false imprisonment?
